I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts you conclude with us as the provider (LaserArt Germany, Melanie Zaun) via the website www.laserart-germany.de. Unless otherwise agreed, the inclusion of your own terms and conditions is objected to.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business is any natural or legal person or partnership acting in the exercise of their independent professional activity.
§ 2 Formation of the Contract
(1) The subject of the contract is the sale of goods.
(2) By listing the respective product, we make a binding offer. The contract is formed via the online shopping cart system.
(3) Process: place goods in the cart → checkout → enter your details and select payment and shipping options → order summary is displayed. Before submitting the order, all details can be reviewed and changed. By clicking the button ("buy" or similar), you bindingly accept the offer.
(4) Offers made on request are non-binding. We will provide you with a binding offer in text form, which you may accept within 5 days.
(5) All information is sent by email. Please make sure your email address is correct.
§ 3 Individually Personalized Goods
(1) You provide us with the personalization details immediately after the contract is concluded.
(2) You may not submit content that infringes the rights of third parties. You indemnify us against any claims by third parties.
(3) We do not check the submitted details for accuracy and accept no liability for errors.
§ 4 Payment Methods
The available payment methods are shown in the shop. Unless otherwise agreed, the purchase price is due immediately. When using external providers (PayPal, Klarna, etc.), their terms and conditions apply in addition.
§ 5 Right of Retention, Retention of Title
(1) A right of retention can only be exercised for claims arising from the same contractual relationship.
(2) The goods remain our property until paid in full.
(3) For businesses: resale is only permitted in the ordinary course of business. Claims are assigned to us in the amount of the invoice total. In the case of processing or combination, we acquire co-ownership in proportion to the invoice value.
§ 6 Warranty
(1) The statutory warranty rights apply.
(2) Consumers: please check the goods for completeness and obvious defects upon delivery.
(3) Businesses: the condition of the goods is determined solely by our specifications. Warranty is provided through repair or replacement. Period: 1 year from delivery (exceptions apply in cases of fraudulent intent, guarantee, injury to life/body/health, or claims related to a building).
§ 7 Choice of Law, Place of Performance, Jurisdiction
(1) German law applies. For consumers, this only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of their country of residence.
(2) The place of performance and jurisdiction is our registered address, provided the customer is a business.
(3) The UN Convention on Contracts for the International Sale of Goods does not apply.

3. Contract Language, Storage of the Contract Text
The contract language is German. We do not store the contract text. Before submitting the order, the details can be printed or saved electronically. After ordering, you will receive the details and the GTC by email.
4. Essential Characteristics of the Goods
The essential characteristics can be found in the respective product description.
5. Prices and Payment Terms
We are a small business within the meaning of § 19 of the German VAT Act (UStG) and therefore do not show value-added tax. Shipping costs are shown separately. For deliveries outside the EU, additional costs such as customs duties or fees may apply, which are to be borne by the buyer.
6. Delivery Conditions
Delivery times are stated in the respective offer. Consumers: risk passes only upon handover of the goods. Businesses: risk passes upon handover to the shipping carrier.
7. Statutory Liability for Defects
Statutory liability for defects applies. See § 6 of the GTC for details.
8. Alternative Dispute Resolution
The European Commission no longer provides a platform for online dispute resolution (ODR).
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
