General Terms and Conditions (GTC) and Customer Information 

I. General Terms and Conditions

§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts that you conclude with us as the provider (LaserArt Germany, Melanie Zaun) via the website www.laserart-germany.de. Unless otherwise agreed, the inclusion of your own terms and conditions is rejected.

(2) A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§ 2 Conclusion of Contract

(1) The subject of the contract is the sale of goods.

(2) By placing the respective product, we make a binding offer. The contract is concluded via the online shopping cart system.

(3) Process: Add items to shopping cart → Checkout → Enter data and select payment and shipping conditions → Display order summary. Before submitting the order, all data can be checked and changed. By clicking the button ("buy" or similar), you accept the offer bindingly.

(4) Offers on request are non-binding. We will submit a binding offer to you in text form, which you can accept within 5 days.

(5) All information will be sent by email. Please ensure that your email address is correct.

§ 3 Individually Designed Goods

(1) You shall provide us with the data for personalization immediately after conclusion of the contract.

(2) You may not transmit any content that infringes the rights of third parties. You shall indemnify us against claims by third parties.

(3) We do not check the transmitted data for correctness and assume no liability for errors.

§ 4 Payment Methods

The available payment methods are indicated in the shop. Unless otherwise agreed, the purchase price is due immediately. When using external providers (PayPal, Klarna, etc.), their terms and conditions apply additionally.

§ 5 Right of Retention, Retention of Title

(1) A right of retention can only be exercised for claims arising from the same contractual relationship.

(2) The goods remain our property until full payment.

(3) For entrepreneurs: Resale only in the ordinary course of business. Claims are assigned to us in the amount of the invoice. In the event of processing or combination, we acquire co-ownership in proportion to the invoice value.

§ 6 Warranty

(1) The statutory defect rights apply.

(2) Consumers: Please check the goods upon delivery for completeness and obvious defects.

(3) Entrepreneurs: Quality only according to our specifications. Warranty by rectification or replacement delivery. Period: 1 year from delivery (exceptions for malice, guarantee, injury to life/body/health, building-related defects).

§ 7 Choice of Law, Place of Performance, Place of Jurisdiction

(1) German law applies. For consumers, this only applies if the protection granted by the state of residence is not withdrawn.

(2) The place of performance and jurisdiction is our registered office, provided the customer is an entrepreneur.

(3) The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

3. Contract Language, Storage of Contract Text

The contract language is German. The contract text is not stored by us. Before submitting the order, the data can be printed or saved electronically. After ordering, you will receive the data and GTC by email.

4. Essential Characteristics of the Goods

The essential characteristics can be found in the respective item description.

5. Prices and Payment Terms

All prices include the statutory VAT. Shipping costs are shown separately. For deliveries outside the EU, additional costs such as customs duties or fees may arise, which must be borne by the buyer.

6. Delivery Conditions

Delivery times are stated in the respective offer. Consumers: Risk passes only upon delivery of the goods. Entrepreneurs: Risk passes upon handover to the shipping company.

7. Statutory Liability for Defects

The statutory liability for defects applies. Details see § 6 GTC.

8. Alternative Dispute Resolution

The European Commission no longer provides a platform for online dispute resolution (OS).
We are not obliged and unwilling to participate in a dispute resolution procedure before a consumer arbitration board.
