General Terms and Conditions (GTC) and Customer Information
I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as the provider ( LaserArt Germany, Melanie Zaun ) via the website www.laserart-germany.de. Unless otherwise agreed, the inclusion of your own terms and conditions is hereby rejected.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. A business is any natural or legal person or partnership that acts in the exercise of its independent professional activity.
§ 2 Formation of the contract
(1) The subject of the contract is the sale of goods.
(2) By placing the respective product on the market, we submit a binding offer. The contract is concluded via the online shopping cart system.
(3) Procedure: Add items to the shopping cart → Checkout → Enter your data and select payment and shipping terms → Display of the order summary. Before submitting the order, all data can be reviewed and changed. By clicking the button ("buy" or similar), you accept the offer.
(4) Offers made on request are non-binding. We will submit a binding offer to you in written form, which you can accept within 5 days.
(5) All information will be sent by email. Please ensure that your email address is correct.
§ 3 Individually designed goods
(1) You shall provide us with the data for personalization immediately after conclusion of the contract.
(2) You may not transmit any content that infringes the rights of third parties. You indemnify us against any claims by third parties.
(3) We do not check the accuracy of the data transmitted and accept no liability for errors.
§ 4 Payment methods
The available payment methods are listed in the shop. Unless otherwise agreed, the purchase price is due immediately. When using external providers (PayPal, Klarna, etc.), their terms and conditions also apply.
§ 5 Right of retention, reservation of title
(1) A right of retention may only be exercised with respect to claims arising from the same contractual relationship.
(2) The goods remain our property until full payment has been received.
(3) For businesses: Resale is permitted only in the ordinary course of business. Claims are assigned to us up to the amount of the invoice. In the event of processing or combining, we acquire co-ownership in proportion to the invoice value.
§ 6 Warranty
(1) The statutory warranty rights apply.
(2) Consumers: Please check the goods upon delivery for completeness and obvious defects.
(3) Contractors: Quality only as specified by us. Warranty by repair or replacement. Time limit: 1 year from delivery (exceptions in case of fraudulent concealment, guarantee, injury to life/body/health, building-related).
§ 7 Choice of law, place of performance, place of jurisdiction
(1) German law applies. For consumers, this only applies if the protection afforded by the country of residence is not withdrawn.
(2) The place of performance and jurisdiction is our registered office, provided the customer is an entrepreneur.
(3) The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

3. Contract language, contract text storage
The contract language is German. We do not save the contract text. Before submitting your order, you can print or save the data electronically. After placing your order, you will receive the data and terms and conditions by email.

5. Prices and payment terms
All prices include VAT. Shipping costs are shown separately. For deliveries outside the EU, additional costs such as customs duties or fees may apply, which are to be borne by the buyer.
6. Delivery conditions
Delivery times are indicated in the respective offer. Consumers: Risk passes to the buyer only upon delivery of the goods. Businesses: Risk passes to the buyer upon handover to the shipping company.
